This website is owned and operated by Cat Action Team, a South African non-profit organisation and approved public benefit organisation:
- NPO registration number: 008-438
- PBO reference number: 930083921
- Email address: actionteam.cat@gmail.com
In these Terms and Conditions, “Cat Action Team”, “CAT”, “we”, “us” and “our” refer to Cat Action Team. “You”, “your”, “customer” and “user” refer to any person who accesses the website, creates an account, purchases a product, makes a donation or uses any service offered through the website.
By accessing this website, placing an order, purchasing or downloading a product, making a donation, creating an account or otherwise using the website, you agree to these Terms and Conditions.
If you do not agree with these Terms and Conditions, you must not use the website or purchase products through it.
2. About Cat Action Team
Cat Action Team is a non-profit organisation that assists abandoned and feral cats in Cape Town, including feeding, rescue support, sterilisation, veterinary assistance, fostering and related animal-welfare activities.
The website may be used to:
- sell downloadable music, ebooks and other digital products;
- advertise or sell physical products;
- accept donations and fundraising contributions;
- promote fundraising campaigns;
- advertise cats available for adoption;
- recruit volunteers;
- advertise events;
- share educational and animal-welfare information; and
- link to products, campaigns or services provided by third parties.
Unless expressly stated otherwise, proceeds received by Cat Action Team from products sold directly through this website are used to support its objectives and animal-welfare work.
Buying a product is a commercial transaction and is not automatically treated as a donation. A section 18A tax-deductible receipt will only be issued when the payment qualifies under South African tax law and Cat Action Team is legally authorised to issue such a receipt.
3. Applicable law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
The website and transactions concluded through it are subject, where applicable, to:
- the Consumer Protection Act 68 of 2008;
- the Electronic Communications and Transactions Act 25 of 2002;
- the Protection of Personal Information Act 4 of 2013;
- the Copyright Act 98 of 1978; and
- other applicable South African legislation.
Nothing in these Terms and Conditions is intended to exclude, restrict or override any consumer right that cannot lawfully be excluded.
4. Eligibility and capacity
By using the website or placing an order, you confirm that:
- you are at least 18 years old and legally capable of entering into a binding agreement; or
- if you are under 18, you have the permission and assistance of a parent or legal guardian.
If you place an order on behalf of another person or organisation, you confirm that you have authority to act on their behalf.
5. Products and services
Products offered through the website may include:
- downloadable music;
- downloadable ebooks;
- digital artwork or other downloadable files;
- access to digital collections;
- pre-order digital products;
- physical books;
- merchandise;
- event-related products; and
- other fundraising products.
We make reasonable efforts to describe products accurately. Images may be illustrative, and colours or appearance may vary according to the device or screen used.
We may correct errors in product descriptions, prices, availability or other website content. If a material error affects an order that has already been placed, we will contact you and offer an appropriate correction, replacement or refund.
6. Third-party products and websites
Some products or campaigns displayed on the website may be supplied or processed by third parties, including external booksellers, music platforms, fundraising platforms or payment providers.
When you follow a link to an external website and complete a transaction there:
- the transaction is concluded with the relevant third party;
- that third party’s terms, privacy policy and refund policy may apply;
- payment and delivery are controlled by that third party; and
- refund requests must generally be submitted to the party that processed the transaction.
Cat Action Team is not responsible for the content, availability, security or practices of an independent third-party website. A link does not necessarily constitute an endorsement of everything published on that website.
7. Prices
Unless stated otherwise:
- all prices are displayed in South African rand;
- the price shown when an order is submitted is the price applicable to that order;
- applicable delivery charges will be displayed before payment for physical products; and
- customers are responsible for any bank, currency-conversion or international transaction charges imposed by their own financial institution.
Cat Action Team will state whether Value-Added Tax is included or applicable. If Cat Action Team is not registered as a VAT vendor, VAT will not be charged and a VAT invoice cannot be issued.
We may change prices at any time, but a price change will not ordinarily affect an order already accepted and paid for.
8. Orders and formation of an agreement
Displaying a product on the website is an invitation to place an order and does not guarantee that the product will remain available.
Your order is an offer to purchase the selected product. An agreement is concluded when:
- your payment has been successfully authorised;
- we accept the order; and
- an order confirmation or download instruction is sent to you.
We may refuse or cancel an order where:
- payment has not been received or authorised;
- a product is unavailable;
- a price or product description contains an obvious error;
- we reasonably suspect fraud, unauthorised payment or unlawful activity;
- you have breached these Terms and Conditions; or
- accepting the order would be unlawful or impractical.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled item using the original payment method, where reasonably possible.
9. Payment
Available payment methods will be displayed during checkout.
Payments may be processed through an independent payment service provider. Cat Action Team does not ordinarily receive or retain your complete card details.
You confirm that:
- you are authorised to use the selected payment method;
- the payment and billing information supplied is accurate; and
- sufficient funds or credit are available to complete the transaction.
You must not make fraudulent payments, use stolen payment information or initiate an unjustified payment reversal or chargeback.
10. Digital products
Digital products may be delivered by:
- an email containing a download link;
- a download link displayed after checkout;
- access through your website account; or
- another delivery method described on the product page.
You are responsible for:
- providing a correct email address;
- checking your inbox, spam and junk folders;
- ensuring that your device can open the advertised file format;
- maintaining a suitable internet connection; and
- downloading and securely backing up your files.
Unless the product page states otherwise, purchasing a digital product gives you a limited, personal, non-exclusive and non-transferable licence to use the product for private purposes.
You may not:
- resell, redistribute, upload or publicly share the files;
- copy or reproduce the product for commercial purposes;
- make the download available through file-sharing services;
- remove copyright, ownership or attribution notices;
- claim the work as your own;
- use the product to train an artificial-intelligence system without written permission; or
- use the product in any unlawful or infringing manner.
Copyright and all other intellectual-property rights remain with Cat Action Team or the identified rights holder.
11. Digital delivery difficulties
If you do not receive your download link within the period stated on the product page, or within a reasonable time if no period is stated, contact us at actionteam.cat@gmail.com.
Please provide:
- your name;
- order number;
- email address used for the order;
- product purchased; and
- a description or screenshot of the problem.
We may verify the order before resending a link or providing replacement access.
A failed download caused by a technical problem on our side will be remedied by restoring access, supplying a replacement file or providing another remedy required by law.
12. Pre-orders
A pre-order is a purchase made before the product’s official release or delivery date.
The estimated release date will be shown on the product page where reasonably possible. Release dates may change because of production, licensing, technical or distribution circumstances.
If a release is materially delayed, we will provide updated information where reasonably possible. You may request cancellation and a refund before the digital product is delivered or made available, unless the product was specially commissioned or another lawful exception applies.
If a pre-ordered product is cancelled and will not be released, we will refund the amount paid for that product.
13. Physical products and delivery
Where physical products are sold directly by Cat Action Team, available delivery or collection options and related charges will be displayed during checkout or agreed with you.
Any delivery date is an estimate unless expressly guaranteed in writing.
You must provide a complete and accurate delivery address. We are not responsible for delays or additional costs caused by incorrect or incomplete information supplied by you.
Risk in a physical product passes to you upon delivery to you or an authorised recipient at the delivery address, subject to applicable consumer law.
If a parcel appears damaged, you should record the damage and notify us as soon as reasonably possible.
14. Donations and fundraising contributions
A genuine donation is a voluntary contribution made without purchasing goods or services in return.
Unless required by law or caused by an error on our side, donations are generally non-refundable after they have been received and allocated to Cat Action Team’s work.
We may consider a refund where:
- a donation was duplicated accidentally;
- the incorrect amount was processed;
- the transaction was unauthorised;
- a material technical error occurred; or
- a refund is otherwise required by law.
A request should be sent promptly to actionteam.cat@gmail.com, together with the payment reference and an explanation.
Where money is contributed toward a particular campaign, animal or project, we will make reasonable efforts to use it for that purpose. If the stated purpose has already been fully funded, becomes impossible, is no longer reasonably required or circumstances change, Cat Action Team may use the contribution for similar animal-welfare work or where the need is greatest.
A fundraising contribution does not give the contributor ownership of, control over or decision-making authority concerning an animal, campaign or Cat Action Team’s operations.
15. Tax-deductible receipts
Cat Action Team’s PBO status does not necessarily mean that every payment qualifies for a tax deduction.
A tax-deductible receipt may only be issued:
- for a qualifying bona fide donation;
- where no material product or service is received in return;
- where the donation supports an activity approved for section 18A purposes; and
- where all applicable South African Revenue Service requirements are satisfied.
Purchases of music, ebooks, physical books, merchandise or other products generally do not qualify as tax-deductible donations.
16. Refunds, returns and cancellations
All refunds, returns and cancellations are governed by our Refund Policy, which forms part of these Terms and Conditions.
Nothing in our Refund Policy limits a right or remedy available under applicable South African law.
17. Accounts and passwords
If the website allows you to create an account, you are responsible for:
- keeping your login details confidential;
- providing accurate account information;
- updating information when it changes; and
- notifying us if you suspect unauthorised access.
You are responsible for activity performed through your account unless the activity resulted from a security failure attributable to us.
We may suspend or terminate an account that is used unlawfully, fraudulently or in breach of these Terms and Conditions.
18. Acceptable website use
You may not:
- interfere with the operation or security of the website;
- introduce viruses, malicious code or automated attacks;
- attempt to gain unauthorised access to the website or another user’s account;
- scrape, harvest or copy website data without permission;
- impersonate another person;
- submit false or misleading information;
- use the website for fraud or unlawful activity;
- infringe intellectual-property or privacy rights; or
- post abusive, defamatory, discriminatory or harmful material.
19. Intellectual property
Unless otherwise indicated, the website’s text, photographs, graphics, logos, artwork, music, recordings, ebooks, downloads and design elements are owned by or licensed to Cat Action Team.
You may view the website for personal and lawful purposes. No content may be commercially reproduced, republished, sold, distributed or adapted without prior written permission from the relevant rights holder.
“Cat Action Team” and associated names, logos and branding may not be used in a manner that falsely suggests endorsement, partnership or affiliation.
20. Adoption, rescue and animal-welfare information
Information about cats, adoption, fostering, bottle feeding, veterinary matters or animal care is provided for general educational purposes.
It is not a substitute for professional veterinary advice, diagnosis or treatment. In an emergency, contact a registered veterinarian or appropriate animal-welfare service immediately.
Submitting an adoption, fostering or volunteer enquiry does not guarantee approval or placement. Cat Action Team may apply screening, home-check, contractual and welfare requirements considered appropriate for the animal concerned.
21. Website availability
We aim to keep the website reasonably available and secure, but we do not guarantee uninterrupted or error-free access.
The website may be suspended for maintenance, security work, technical difficulties or circumstances outside our reasonable control.
We may update, remove or discontinue website content or functionality, provided that this does not unlawfully affect an existing order.
22. Disclaimer and limitation of liability
To the fullest extent permitted by law:
- the website is provided on an “as available” basis;
- we do not guarantee that every item of general website content is complete or error-free;
- we are not liable for indirect, incidental or consequential loss arising from use of the website; and
- we are not liable for failures caused by circumstances beyond our reasonable control.
Nothing in these Terms and Conditions excludes or limits liability for gross negligence, fraud, wilful misconduct or any liability that cannot lawfully be excluded.
Where liability may lawfully be limited, our aggregate liability relating to a particular product will not exceed the amount paid for that product.
23. Privacy
We process personal information in accordance with applicable data-protection law and our Privacy Policy.
Information may be shared with payment providers, delivery providers, hosting providers and other service providers where reasonably necessary to process an order, administer the website, prevent fraud or meet legal obligations.
24. Complaints and dispute resolution
Please send complaints to:
Cat Action Team
Email: actionteam.cat@gmail.com
Include your name, order number, relevant dates and a clear description of the problem.
We will attempt to resolve complaints reasonably and in good faith.
If a consumer dispute cannot be resolved directly, the customer may approach an appropriate consumer-protection body, ombud, regulator or court with jurisdiction.
25. Electronic communications
By submitting an order, enquiry or account registration, you consent to receiving communications reasonably necessary for that transaction or relationship.
Marketing communications will be handled separately from essential order and service communications. Where required, marketing will only be sent with the appropriate consent, and you may unsubscribe from it.
26. Changes to these Terms and Conditions
We may update these Terms and Conditions to reflect changes in law, products, payment methods or website operations.
The revised version will be published on the website with a new “last updated” date. The terms applying to an order will generally be those in effect when the order was placed, unless a legal change must apply immediately.
27. General provisions
If any part of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
A failure to enforce a provision immediately does not constitute a waiver of that provision.
You may not transfer your rights or obligations under an order without our written permission. Cat Action Team may transfer its rights or obligations where this does not reduce your statutory consumer rights.
